Terms of Service
Last updated: 2026-10-26
1. Provider and scope
Maxwell is a free bot for the chat platform Fluxer with a web dashboard. The provider is Rainer Schnittert, Tannenstr. 8, 90762 Fürth, Germany ("we"), see the legal notice. Maxwell is run privately and not for profit.
Maxwell is not a Fluxer product and is not affiliated with Fluxer Platform AB.
These terms govern adding Maxwell to a community and using the dashboard. You accept them by adding Maxwell to a community or signing in to the dashboard. How we process data is described in the privacy policy.
2. Who may use Maxwell
- You need a Fluxer account and must follow Fluxer's terms.
- To add Maxwell to a community or use the dashboard, you must be at least 16 years old and at least the age Fluxer requires in your country. If you are under 18, you need the consent of your parent or legal guardian.
- You may only add Maxwell to communities where you have the right to do so.
3. What Maxwell offers
- Maxwell offers moderation, logs, AutoMod, welcome messages, levels, backups and the other modules shown on the website. Admins turn them on and set them up in the dashboard.
- There is no entitlement to Maxwell or any feature being available at all times, working without errors or being offered permanently. We may change, restrict or remove features, for example when Fluxer changes or security requires it.
- Some modules unlock after a vote on fluxerlist.com. We may change which ones.
4. Responsibility of community admins
- Admins decide which modules run in their community and how. They are responsible for using Maxwell in line with Fluxer's terms and the law, and for telling their members what Maxwell does there, for example that messages are logged or that tickets have transcripts.
- Admins are responsible for the content they put into Maxwell, such as welcome messages, custom commands, feeds and pictures. Only use pictures and texts you have the rights to.
- Moderation decisions made with Maxwell are decisions of the community's moderators, not ours.
5. What is not allowed
You may not use Maxwell for:
- Spam: unwanted mass messages or DMs, advertising without consent, invite spam.
- Raids and disruption: flooding or disrupting communities, taking over other people's communities.
- Deception: presenting yourself as Maxwell, Fluxer or Fluxer staff.
- Data harvesting: collecting or passing on messages, profiles or member data beyond what the modules are meant for.
- Illegal content: for example child sexual abuse material, terrorist content, incitement to hatred, threats, defamation, infringement of copyright or personality rights, publishing other people's private information, fraud, phishing.
- Harassment and hate: targeted harassment, hate against people or groups, calls for violence.
- Attacks: attacks on our or other systems, including through feeds or picture addresses.
- Misusing Maxwell Shield: sharing bans that are not about raids, spam or attacks, for example because of a personal dispute.
- Circumventing safeguards: getting around cooldowns, vote checks or security features of Maxwell or Fluxer, exploiting security vulnerabilities. Please report vulnerabilities to [email protected].
- Violating Fluxer's terms or Fluxer's rules for bots.
- Templates with illegal or hateful names or descriptions.
6. Measures
- If Maxwell is misused in a community, we may switch off modules there, remove Maxwell from the community or block it from being added again. We choose the mildest measure that is sufficient and take into account the severity and frequency of the violation.
- We tell the admins of the community what we did and why, as far as we can reach them, and how they can object. You can object by email to [email protected] within 6 months; we review the decision again and tell you the result. Independently of this, you can go to court or complain to the German Federal Network Agency (Bundesnetzagentur) as Digital Services Coordinator.
7. Reporting content
Anyone, even without an account, can report content they believe is illegal and that Maxwell stores or posts, such as a welcome message, a custom command or a picture, to [email protected]. Please explain why the content is illegal, where exactly it can be found (for example the community and a link to the message), give your name and email address (except for child sexual abuse material) and state that your information is accurate and complete to the best of your knowledge. We confirm receipt, decide promptly, diligently and objectively, and tell you our decision. Please also report content that sits directly on Fluxer to Fluxer, because only Fluxer can remove it there.
8. Point of contact under the Digital Services Act
Single point of contact for users and for authorities of EU Member States, the Commission and the European Board for Digital Services (Art. 11 and 12 DSA):
Email: [email protected]
Languages: German, English
9. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
- For slight negligence we are only liable if we breach an essential contractual obligation, meaning an obligation that makes the use of Maxwell possible in the first place and on which you may rely. In that case liability is limited to the foreseeable, typical damage.
- Otherwise liability is excluded.
- Sections 9(1) to 9(3) also apply to our legal representatives and vicarious agents.
- Backups made by Maxwell do not replace your own. Fluxer may change or remove things Maxwell cannot restore.
10. Indemnity
If you culpably violate these terms or the rights of third parties and third parties bring claims against us as a result, you will indemnify us against those claims, including reasonable legal defense costs.
11. Term and termination
- You can stop using Maxwell at any time by removing it from your community.
- We can discontinue Maxwell with 4 weeks' notice. We will announce it in the dashboard.
- Both sides keep the right to terminate for good cause. For us, good cause is above all a serious or repeated violation of section 5.
12. Changes to these terms
We may change these terms if Maxwell, Fluxer or the law changes. We announce significant changes in the dashboard at least 4 weeks in advance and say what changes.
13. Governing law, jurisdiction, language
- German law applies. If you are a consumer with your habitual residence in another country, you keep the protection of the mandatory provisions of that country's law.
- If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Fürth, Germany. For consumers, the statutory places of jurisdiction apply.
- These terms are written in English.
- We do not take part in and are not obliged to take part in dispute resolution proceedings before a consumer arbitration board.
